Licence terms — subject to written confirmation

What this permission covers

Subject to written confirmation, Guitar Company Alba Limited, trading as Alba GB Editions, grants the named artist or ensemble a non-exclusive, non-transferable licence for one identified work and its specified edition or arrangement, for one self-produced recording project. The project may include one audio recording and a corresponding performance video of the same interpretation.

Proposed scope: worldwide online availability on the artist’s named website, social/video channels and digital streaming or download services for three years from the agreed first release date. Ordinary platform advertising revenue is permitted. Only the composition or arrangement rights expressly identified in the written confirmation are granted.

How the fee is selected

The fee applies per work and arrangement, not per upload. Instrumentation means the instrumental parts in the licensed edition, not the number of overdubs or uploads. Duration means the complete recorded performance of that work, including all its movements. Exactly 4:00 falls in the first band; exactly 12:00 in the second. Vocal works, changed instrumentation, extracts, medleys and projects involving several works require an individual scope check.

The same confirmed recording may appear on the platforms named in the licence without paying this fee again. A new performance recording, different arrangement, additional work or use outside the agreed scope requires a new written agreement.

What is not included

This permission does not replace any public-performance, mechanical, platform or collecting-society licence required for the use or territory. It does not grant rights in someone else’s recording, performance, photograph or video. The customer must obtain those permissions separately where required.

Physical manufacture, broadcast, film, advertising, sponsorship, games, course content, new arrangements, sublicensing and redistribution or public display of the score PDF are excluded unless separately agreed. No fee will be charged for Alba permission that is unnecessary, already covered or outside Alba’s licensing authority.

Confirmation, credits and release

A score purchase, option selection or enquiry is not a licence. Alba will confirm the work, AGBP reference, licensee, recording, platforms, territory, term, rights granted and total fee in writing. Permission begins only after that confirmation and any agreed payment. This is not retrospective clearance for an unauthorised release.

Use the credits specified in the confirmation, including the work, composer, arranger where applicable and Alba GB Editions. Keep performer and master-recording credits separate. Platform copyright claims must be checked against the confirmed rights; this permission does not guarantee automatic claim removal or monetisation approval.

Expiry, changes, cancellation and disputes

Before expiry, request a written renewal or remove the licensed recording from public availability by the expiry date. Lawfully supplied customer downloads do not have to be recalled; no further distribution is authorised after expiry. Private archival copies may be retained.

If the project changes, seek written agreement before making the new use. If Alba cannot grant the confirmed rights, payments for the ungrantable permission will be refunded. Mandatory consumer cancellation and other statutory rights remain unaffected; no blanket ‘non-refundable’ term is proposed. Any separate early-start consent must be obtained lawfully before supplying a licence.

For a material breach, written notice will identify the issue and allow 14 days to remedy it where remedy is possible; unlawful or third-party-infringing use may require immediate suspension. If unresolved, the affected permission may be terminated. Proposed governing law: England and Wales, without removing mandatory protections or court rights available to consumers in their home country.

Live performance is a separate question

Do not buy a recording permission solely to perform a work live. Public-performance licensing may be handled by the venue, promoter or a collecting society. Check the applicable arrangements for your country and event; Alba will only confirm rights it can administer.
